Digital Millennium Copyright Act Policy, Notice and Takedown Procedure

It is our policy to expeditiously respond to proper notices of alleged copyright infringement that comply with the United States Digital Millennium Copyright Act (DMCA), (the text of which can be found at the U.S. Copyright Office Web Site, http://www.copyright.gov).

It is expected that all users of any part of WhichCar.org will comply with applicable copyright laws. If, however, we receive proper notification of claimed copyright infringement, our response to such notices will include removing or disabling access to material claimed to be the subject of infringing activity and/or terminating contributors, regardless of whether we may be liable for such infringement under United States law or the laws of another jurisdiction.

If we remove or disable access in response to such a notice, we will make a good-faith attempt to contact the creator of the affected content so that they may make a counter notification pursuant to Sections 512(g)(2) and (3) of the DMCA. We may also document notices of alleged infringement on which we act.

INFRINGEMENT NOTIFICATION: Filing a DMCA Notice of Copyright Infringement

Upon receipt of proper notification of claimed infringement, WhichCar.org will follow the procedures outlined herein and in the DMCA.

To file a notice of infringement with WhichCar.org, you must provide a written communication (by email, fax and mail) that sets forth the information specified in the list below.

Please note that you will be liable for damages (including costs and attorney’s fees) if you materially misrepresent that material is infringing your copyright(s). Accordingly, if you are not sure if you are the proper copyright holder or if copyright laws protect the material of yours, you may want to consult an attorney.

To expedite our ability to process your request, please use the following format (including section numbers):

Your contact information, including your name, address, telephone number, and, if available, an email address at which you, as the complaining party, may be contacted;

The statement: “I am the copyright owner or an agent authorized to act on the owner’s behalf of the following copyrighted material:”;

Identify with sufficient detail the copyrighted content that you believe has been infringed. (For example, “The copyrighted image at issue is the “Content Title” which can be described as “Description: literary work, image, etc.” by “name of the author”, including any federal registration information if available);

Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit WhichCar.org to locate the material (e.g. “Title of Article” at this location: https://whichcar.org/link-to-article/);

The following statement: “I have a good faith belief that use of the aforementioned material in the manner complained of is not authorized by the copyright owner, its agent, or the law”;

The following statement: “I swear, under penalty of perjury, that the information in the notification is accurate”; and

Sign the document.

Counter Notification

To file a counter notification with us, you must provide a written communication (by regular mail) that sets forth the information specified in the list below. Subject to prior written agreement you may not communicate the information specified below by email. Please note that you will be liable for damages (including costs and attorneys’ fees) if you materially misrepresent that a product or activity is not infringing the copyrights of others.
To expedite our ability to process your request, please use the following format (including section numbers):

Upon receipt of such counter notification, WhichCar.org will promptly provide the person who provided the original infringement notification with a copy of the counter notification, and inform that person that WhichCar.org will replace the removed material or cease disabling access to it in 10 business days. WhichCar.org will replace the removed material and cease disabling access to it not less than 10, nor more than 14, business days following receipt of the counter notice, unless our Designated Agent first receives notice from the person who submitted the original infringement notification that such person has filed an action seeking a court order to restrain the subscriber from engaging in infringing activity relating to the material on our system or network.

Repeat Infringers

In accordance with Section 512(i)(1)(A) of the DMCA, WhichCar.org will, in appropriate circumstances, disable and/or terminate the accounts of contributors who are repeat infringers.

We believe we will be able to resolve any disputes or issues you may have regarding our site and services by emailing info@inkds.com. In the event that we are not able to resolve a dispute or issue, you agree to the following resolution process.

We each agree to resolve disputes through binding arbitration or in small claims court rather than in a court of general jurisdiction. Arbitration uses a neutral arbitrator instead of a judge or jury and is less formal than a lawsuit in court. We each agree that each party will assert claims in arbitration only in our individual capacity, and not as a representative or member of any purported class. The arbitrator has no authority to arbitrate claims on a class-wide basis and shall not consolidate, combine, or jointly arbitrate claims of more than one person in a single arbitration. We each agree to waive our constitutional and statutory rights to go to court and have a trial in front of a judge or a jury, electing instead to resolve by binding arbitration on all claims. Small claims are not subject to arbitration. We each agree that either party may bring individual claims in small claims court. Either party may initiate an arbitration proceeding, which will be conducted by a single arbitrator. We each agree to initiate arbitration before JAMS, Inc. (“JAMS”) or any successor to JAMS, which is an alternative dispute resolution provider (“ADR Provider”). In the event JAMS is unwilling or unable to set a hearing date within fourteen (14) days of the filing of a “Demand for Arbitration”, then either party can elect to have the arbitration administered by another mutually agreeable arbitration administration service who will hear the case. The arbitration will be conducted under the JAMS Streamlined Arbitration Rules and Procedures (available at www.jamsadr.com) (“Arbitration Rules”). The rules of the ADR Provider will govern all aspects of the arbitration, except to the extent such rules are in conflict with this Arbitration Agreement. If an in-person hearing is required, then it will take pace in Orlando, FL, unless the claimant resides outside the United States, in which case the arbitrator will give each party reasonable notice of the date, time and place of any oral hearings. Payment of all filing, administrative, and arbitrator fees will be governed by the Arbitration Rules. The arbitrator will decide the rights and liabilities, if any, of the parties, and the dispute will not be consolidated with any other matters or joined with any other cases or parties. The arbitrator will have the authority to grant motions dispositive of all or part of any Claim. The arbitrator will have the authority to award monetary damages, and to grant any non-monetary remedy or relief available to an individual under applicable law, the ADR Provider’s Rules, and this Arbitration Agreement. The arbitrator will issue a written award and reasoned statement of decision describing the essential findings and conclusions on which the award is based, including the calculation of any damages awarded. The arbitrator has the same authority to award relief on an individual basis that a judge in a court of law would have. Any award will be subject to judicial confirmation or entry in any court having jurisdiction. This Arbitration Agreement is governed by the Federal Arbitration Act and federal arbitration law. All aspects of the arbitration proceeding, including but not limited to, the award of the arbitrator and compliance therewith, will be strictly confidential. The parties agree to maintain confidentiality unless otherwise required by law. This paragraph will not prevent a party from submitting to a court of law any information necessary to enforce this Arbitration Agreement or to enforce an arbitration award.

Unsolicited Submissions

WhichCar.org does not want you to submit confidential information to us through this site except as it may be required in connection with your use of our services.
